People often search for insured versus underinsured coverage when they are trying to understand who pays after an accident. The more common comparison is uninsured versus underinsured motorist coverage, and knowing the difference can make a major difference in your financial recovery.

Medical care, missed paychecks, physical pain, and future treatment can quickly exceed an at-fault driver’s policy limits. Your own auto policy may provide another source of compensation, but insurers do not always make the process clear or easy. Here is what California drivers and accident victims need to know.

Insured versus underinsured coverage: What is the difference?

An uninsured motorist claim may apply when the driver who caused the collision has no liability insurance. It can also apply in certain hit-and-run crashes where the at-fault driver cannot be identified. In that situation, you generally turn to the uninsured motorist coverage on your own policy rather than pursuing coverage from the other driver.

An underinsured motorist claim applies when the at-fault driver has liability insurance, but their policy limit is too low to fully compensate you. The driver is insured. Their coverage is simply inadequate for the losses they caused.

For example, imagine another driver runs a red light in San Luis Obispo and causes a collision that leaves you with $150,000 in medical bills, lost income, and other damages. If that driver carries a $30,000 injury liability policy, their insurer may pay up to that limit. If you have underinsured motorist coverage with higher limits, you may be able to make a claim under your own policy for additional compensation.

The distinction matters because the notice requirements, evidence, policy language, and insurer arguments can differ. Both types of claims can become contested when an insurer disputes fault, the seriousness of injuries, or the value of future losses.

Why the other driver’s insurance may not be enough

California requires drivers to carry liability insurance, but required minimum coverage does not guarantee meaningful protection after a major crash. As of 2025, California’s minimum bodily injury liability limits are $30,000 per injured person and $60,000 per accident. Those limits can be exhausted quickly after an ambulance ride, emergency care, imaging, surgery, or extended rehabilitation.

A driver may have a valid insurance card and still be underinsured. This is especially common when a collision causes a traumatic brain injury, spinal injury, broken bones, burns, permanent limitations, or a wrongful death. A commercial vehicle collision or motorcycle crash can create damages far beyond a basic policy limit.

The at-fault driver’s personal assets may also be limited. That is why uninsured and underinsured motorist coverage can be one of the most valuable protections on your own auto policy.

How underinsured motorist coverage works in California

Underinsured motorist coverage, often called UIM coverage, is intended to help bridge the gap between the at-fault driver’s available liability coverage and the losses you can prove. It does not automatically pay every dollar of your damages, and it is not simply added on top of the other driver’s policy limit.

California uses an offset approach. In general, the amount available through UIM coverage is reduced by the liability payment received from the at-fault driver’s insurer.

Consider a driver who carries $100,000 in UIM coverage. If the negligent driver has a $30,000 policy and pays its full limit, up to $70,000 may remain available under the injured person’s UIM coverage, depending on the policy, the facts, and the value of the claim. If the injured person’s UIM limit is the same as or lower than the at-fault driver’s liability limit, UIM coverage may not provide an additional payment.

This is one reason policy limits deserve close attention. A settlement offer that sounds substantial may be far less than what is needed for future care, lost earning capacity, and the full human impact of a serious injury.

Your policy may cover more than you expect

UM and UIM coverage may protect you not only when you are driving your own car. Depending on the policy and circumstances, coverage can apply when you are a passenger, riding in someone else’s vehicle, walking, or riding a bicycle when struck by an uninsured or underinsured driver.

Family members listed on the policy may also be covered. However, coverage depends on the exact policy terms, the vehicles involved, household status, exclusions, and available limits. Never assume there is no coverage just because you were not behind the wheel.

Do not settle too quickly with the other driver’s insurer

This is one of the most consequential issues in an underinsured motorist claim. Before accepting a settlement from the at-fault driver’s insurer, you should notify your own insurer and understand your UIM policy’s consent-to-settle requirements.

Your insurer may have rights connected to the claim against the negligent driver. Settling or signing a release without proper notice can create an argument that you gave up your right to UIM benefits. The other insurer may pressure you to sign quickly, particularly when its policy limits are low. That pressure serves its interests, not necessarily yours.

You also need a clear picture of your injuries before deciding whether the offered limits are enough. Some injuries worsen over time. A back injury, concussion, nerve damage, or joint injury may require prolonged treatment and may affect your ability to work long after the vehicle damage has been repaired.

What to do after a crash involving an uninsured or underinsured driver

Your health comes first. Get medical attention promptly and follow through with recommended care. Delays can give an insurance company room to argue that you were not seriously injured or that the crash did not cause your condition.

Then report the collision to law enforcement when appropriate, preserve photos and contact information, and keep copies of medical records, bills, repair estimates, and communications from insurers. Notify your own insurance company of a potential UM or UIM claim, but be careful about recorded statements or broad medical authorizations before you understand what is being requested.

Insurance companies may present themselves as helpful because you are their policyholder. But when you make a UM or UIM claim, your insurer is evaluating whether it must pay benefits. It may challenge liability, argue that treatment was unnecessary, minimize pain and limitations, or claim that a settlement offer already fully compensated you.

An experienced injury attorney can investigate the crash, identify every possible source of coverage, calculate the full value of your losses, and handle insurer communications. That matters when you are trying to heal and cannot afford a preventable mistake with your claim.

Choosing UM and UIM limits before an accident

The best time to review uninsured and underinsured motorist coverage is before a collision happens. In California, insurers generally must offer UM and UIM coverage, and rejecting it requires a written waiver. Many drivers accept lower limits to reduce premiums without realizing how little protection remains after a serious crash.

There is no single right amount for every household. Higher limits can cost more, and the practical choice depends on your finances, vehicles, family members, and tolerance for risk. Still, it is worth comparing your UM/UIM limits with your liability limits and considering the cost of a major injury rather than only the cost of the premium.

After a crash, the policy you already had controls. The focus becomes finding all available coverage and protecting your right to a fair recovery.

If an uninsured or underinsured driver has turned your life upside down, do not let an insurance company rush the decision.
