What Is Assault and Battery?
California law defines assault several different ways:
- Simple assault — A misdemeanor simple assault is an unlawful attempt to commit a violent injury on another. No injury, or even contact, needs to have taken place for simple assault to occur.
- Simple battery — This offense involves a willful and unlawful use of violence or force on another person. Depending on the judge, simple battery can be ruled a misdemeanor or a felony.
- Assault with a firearm — Although also a felony, assault with a firearm does not have to result in great bodily harm. Just the fact that one is in possession of a firearm during the act of assault is enough to make this crime a felony.
- Assault with a deadly weapon — This offense occurs when one person assaults another with a deadly weapon in a manner likely to produce great bodily harm. Other than with a firearm, assault with a deadly weapon is a felony.
Of course, mitigating factors apply to all of these situations, adding to or minimizing legal consequences. After an assault, your lawyer can explain the likely penalties your assailant faces.
You May be Able to Sue for Personal Injury and Assault and Battery
If you are a victim of assault and battery, you may be able to bring a personal injury suit against the guilty party. Speak to our assault attorneys about your options. A personal injury case can help you with the costs associated with your injuries, such as medical bills, lost wages and pain and suffering. Moreover, a personal injury suit discourages the defendant from ever committing that sort of behavior again.
